Booknz Booking Terms
These Booking Terms are between Booknz Inc. ("Booknz", "we", "us", or "our") and the person using a Booknz booking page to book with an independent professional ("you" or "Client").
Booknz is a federally incorporated Canadian company launching GTA-first in Ontario. Booknz provides a mobile web booking link that lets you book services with independent beauty and personal-care professionals. Clients use the booking link for free. The professional you book with is called the "Professional".
By using a Booknz booking page, requesting an appointment, paying a deposit, or communicating through Booknz, you agree to these terms.
1. Booknz Is a Platform
1.1 Booknz is a software platform. Booknz is not the barber, hairstylist, braider, lash technician, nail technician, makeup artist, tattoo artist, or other service provider.
1.2 The Professional is the person or business providing the service. The Professional is independent from Booknz.
1.3 Booknz does not employ, vet, licence, supervise, train, direct, manage, or control Professionals.
1.4 Booknz does not guarantee a Professional's identity, qualifications, licensing, insurance, availability, quality, safety, hygiene practices, legal compliance, punctuality, conduct, location, pricing, cancellation policy, refund policy, or service outcome.
1.5 You and the Professional transact at your own risk.
2. Client Eligibility and Age
2.1 Booknz does not decide whether you are legally eligible to receive a specific service. The Professional is responsible for deciding whether they can lawfully accept, book, and serve you based on your age, capacity, consent, parental or guardian consent, the service type, and applicable law.
2.2 If you are booking for someone else, you must have authority to provide their information and make the booking.
2.3 Some services may require you to be an adult, have parental or guardian consent, sign a consent form, or meet other legal or safety requirements. The Professional is responsible for telling you what applies to the service. Booknz is not responsible for the Professional's service-specific eligibility, consent, licensing, insurance, health, safety, hygiene, or aftercare requirements.
3. Bookings
3.1 A booking request or confirmation is between you and the Professional.
3.2 The Professional controls their own availability, services, prices, deposits, travel fees, cancellation policy, no-show policy, preparation instructions, aftercare instructions, and refund policy.
3.3 Booknz may help deliver booking confirmations, reminders, cancellation notices, rescheduling messages, and other service messages, but Booknz is not responsible for whether the Professional or Client attends the appointment.
3.4 You are responsible for giving accurate booking information, including your name, contact details, selected service, appointment time, address for house calls, building access instructions, and relevant notes.
4. Deposits, Payments, Refunds, and Cancellations
4.1 Booknz supports client deposits through Stripe Connect. Deposit payments are processed by Stripe and routed to the Professional's connected Stripe account. Booknz does not hold client deposits as escrow or as a stored balance outside the Stripe Connect payment-processing flow.
4.2 Deposit, refund, cancellation, no-show, and rescheduling policies are set by the Professional. Booknz may display, transmit, or help process those policies through the platform, but Booknz is not responsible for the Professional's policies or for the Professional's decision to charge, waive, refund, or keep a deposit or fee.
4.3 Read the Professional's policies before booking. If you have a dispute about a deposit, refund, cancellation, no-show fee, travel fee, or service result, you should contact the Professional first.
4.4 Booknz may help pass messages between you and the Professional, but Booknz does not promise to resolve payment or service disputes.
5. House Calls and In-Home Services
5.1 Some Professionals offer house calls, where the Professional travels to your location.
5.2 If you book a house call, you are responsible for providing accurate address, access, parking, building, pet, safety, and contact information.
5.3 You are responsible for making sure the appointment location is safe, lawful, and suitable for the service.
5.4 House calls and in-person services involve real-world risks, including injury, allergic reaction, illness, property damage, theft, unsafe conditions, harassment, assault, dissatisfaction with the service, or disputes between you and the Professional.
5.5 Booknz does not inspect your location, accompany the Professional, supervise the appointment, or guarantee anyone's conduct.
5.6 If there is an emergency, immediate danger, threat, injury, assault, harassment, unsafe location, or other urgent safety issue, contact local emergency services first. Booknz is not an emergency service and does not monitor, attend, supervise, or control appointments. You may also report platform misuse or safety concerns to Booknz after taking appropriate emergency steps.
6. Client Notes and Sensitive Information
6.1 A Professional may ask you for notes that help provide the service, such as style preferences, allergies, skin or scalp conditions, accessibility needs, address instructions, or other appointment details.
6.2 Some notes may be sensitive personal information. Only provide information you are comfortable sharing with the Professional and that is relevant to the appointment.
6.3 The Professional is responsible for collecting and using your client notes with appropriate consent. Booknz stores and processes those notes as a service provider for the Professional, as explained in the Privacy Policy.
6.4 If you want a Professional to correct or delete notes they keep about you, contact the Professional. You may also contact Booknz for help with platform-stored information.
7. SMS, Email, and Communications
7.1 Booknz and the Professional may send transactional booking messages, including confirmations, reminders, rescheduling notices, cancellation notices, payment-related messages, account messages, and support messages.
7.2 Promotional SMS or email messages require express opt-in unless another lawful basis clearly applies.
7.3 Promotional messages must include a working unsubscribe method. You can withdraw promotional consent at any time.
7.4 You are responsible for any carrier, SMS, data, or email costs charged by your provider.
8. Portfolio Photos and Client Likeness
8.1 Professionals may display portfolio photos on Booknz.
8.2 If a Professional wants to upload or display a photo where you are identifiable, the Professional is responsible for getting your permission.
8.3 If you believe a photo on Booknz includes your likeness without permission, contact Booknz using the contact information below.
9. Acceptable Use
9.1 You must not:
- use Booknz for unlawful, unsafe, harassing, deceptive, discriminatory, exploitative, or non-consensual conduct;
- provide false booking, payment, address, or contact information;
- interfere with the platform or try to access another person's account or information;
- threaten, harass, abuse, or harm a Professional, another Client, or Booknz personnel;
- use Booknz to send spam or unlawful messages; or
- misuse booking links, reminders, payment flows, or support channels.
10. Privacy
10.1 Our Privacy Policy explains how Booknz handles personal information.
10.2 For information a Professional collects about their own clients through Booknz, the Professional is the controller or organization responsible for that information, and Booknz is the service provider or processor.
10.3 For Booknz platform data, support data, security logs, analytics, and communications that Booknz controls, Booknz is the controller or organization responsible for that information.
11. Service Availability
11.1 Booknz is provided on an "as is" and "as available" basis.
11.2 We do not promise that the booking link will always be available, error-free, secure from every threat, or compatible with every device, browser, SMS carrier, email provider, payment method, or third-party service.
12. Assumption of Risk
12.1 You understand that beauty, personal-care, tattoo, mobile, and in-home services can involve risk.
12.2 To the maximum extent allowed by law, you assume the risks of booking, receiving, cancelling, rescheduling, paying for, or participating in services provided by a Professional.
12.3 Booknz is not responsible for the Professional's services or conduct, your conduct, the appointment location, or what happens during the in-person appointment.
13. Limitation of Liability
13.1 To the maximum extent allowed by law, Booknz is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunity, lost data, loss of goodwill, service dissatisfaction, injury, illness, allergic reaction, property damage, theft, unsafe locations, missed appointments, refunds, deposits, or disputes with a Professional.
13.2 To the maximum extent allowed by law, Booknz's total liability for all claims relating to the platform or these terms is limited to C$100.
13.3 Some laws do not allow certain limits. If those laws apply, the limits apply only to the fullest extent permitted.
14. Indemnity
14.1 You agree to defend, indemnify, and hold harmless Booknz, its directors, officers, employees, contractors, service providers, and affiliates from claims, losses, liabilities, damages, penalties, costs, and expenses, including reasonable legal fees, arising from:
- your booking information;
- your conduct before, during, or after an appointment;
- your location, house-call environment, or access instructions;
- your dispute with a Professional;
- your violation of these terms; or
- your misuse of Booknz.
15. Changes to These Terms
15.1 We may update these terms from time to time.
15.2 If a change is material, we will give notice using a reasonable method, such as website notice, booking-page notice, SMS, email, or support notice.
15.3 If you use Booknz after an updated version takes effect, you accept the updated terms.
16. Governing Law
16.1 These terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario.
16.2 The courts located in Ontario, Canada will have jurisdiction over disputes, unless applicable consumer protection or other mandatory law gives you different rights.
